Terms of use
These Terms of Use (“Terms”) govern your access to and use of shortwaypoint.com and related online services operated by Short Waypoint Travel Pty Ltd (ABN example 12 345 678 901), trading as Short Waypoint (“we”, “us”, “our”) (together, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, you must not use the Site.
Additional terms may apply to specific products (for example digital route packs, subscriptions or partner offers). Those terms are presented at checkout or download and, where they conflict with these Terms on a specific transaction, the additional terms prevail for that transaction only.
Eligibility and acceptable use
You must be at least 18 years old, or have obtained verifiable consent from a parent or legal guardian, to use the Site in a way that involves submitting personal information or entering contracts. You agree not to misuse the Site, including by attempting to gain unauthorised access to systems, scraping the Site in a manner that degrades performance, introducing malware, harassing other users or our staff, or using automated means to circumvent rate limits or technical controls we apply.
We may suspend or terminate access where we reasonably believe you have breached these Terms, created risk for others, or are required to do so by law.
Informational content and limitations
The Site provides travel inspiration, indicative itineraries, pricing ranges in Australian dollars where stated, and editorial material. Except where we expressly sell a defined product with its own description, content is general information only and is not tailored professional advice (for example medical, insurance, migration or legal advice). Conditions on the ground—road closures, park permits, weather, cultural protocols, operator hours—change frequently. You are responsible for verifying critical facts with operators, land managers and official sources before you travel.
Maps, distances and durations are estimates unless explicitly stated otherwise. “From” prices typically reflect indicative per-person baselines and may exclude flights, fuel surcharges, park fees, equipment hire, peak-season premiums or taxes unless stated.
Intellectual property
Unless otherwise indicated, we or our licensors own copyright and other intellectual property rights in the Site, including text, layout, graphics, logos, icons, photographs and software. You may view and print reasonable portions of the Site for personal, non-commercial planning, and share links to pages, subject to you not removing proprietary notices or misleading others about the source of the material.
You must not reproduce, republish, systematically download, commercially exploit, or create derivative works from the Site without our prior written consent, except where permitted under the Copyright Act 1968 (Cth) or other applicable law.
Your content and licence to us
If you submit reviews, comments, images or other content (“User Content”), you represent that you have the rights to submit it and that it does not infringe third-party rights or contain unlawful material. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt and display User Content for the purpose of operating, promoting and improving the Site, until you delete it or we remove it in accordance with these Terms.
We may moderate User Content and refuse or remove material that we reasonably consider offensive, misleading, spam, or contrary to law or these Terms, without notice where appropriate.
Third-party links and integrations
The Site may link to accommodation providers, national parks, airlines, payment processors or social networks. Those services are operated by third parties under their own terms and privacy policies. We are not responsible for their availability, accuracy or practices. Inclusion of a link does not imply endorsement unless we say so explicitly.
Orders, payments and digital delivery
Where you purchase a paid product, you agree to pay the price shown at checkout plus applicable taxes. Payment processing may be handled by a third-party gateway; we do not store full payment card numbers on our servers where card payments are processed by the gateway.
Digital products are generally supplied by download or email. Risk of loss for digital content passes when the content is made available to you. Our Refund policy explains when refunds may be available for trip-related products.
Newsletters and marketing
If you subscribe to email updates, you consent to receive messages at the address you provide until you unsubscribe. You may unsubscribe using the link in each email or by contacting us. We may measure opens and clicks in aggregate to improve relevance.
Disclaimers
To the maximum extent permitted by Australian consumer law and other applicable law, the Site is provided on an “as is” and “as available” basis. We exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement where lawful. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
Nothing in these Terms limits any non-excludable guarantee, warranty or term implied by the Australian Consumer Law in relation to goods or services we supply to consumers.
Limitation of liability
Subject to the preceding paragraph, our total aggregate liability arising out of or in connection with these Terms or the Site (whether in contract, tort including negligence, statute or otherwise) is limited, at our option, to re-supplying the affected services or paying the amount you paid us for the relevant product in the twelve months before the claim arose, or AUD $100 if no amount was paid.
To the maximum extent permitted by law, we are not liable for indirect, consequential, special or punitive loss, or for loss of profit, revenue, goodwill, data or opportunity, except where such exclusion is prohibited by law.
Indemnity
You agree to indemnify and hold harmless Short Waypoint Travel Pty Ltd and its officers, employees and contractors from claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your misuse of the Site, except to the extent caused by our fraud or wilful misconduct.
Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia sitting in New South Wales.
Changes
We may amend these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms, except where a stricter consent requirement applies by law.
